Welcome to FoodChacha. These Terms & Conditions ("Terms") govern your use of the FoodChacha mobile application, website, and related services (collectively, the "Platform").
By accessing or using FoodChacha, you agree to be legally bound by these Terms.
1. Definitions
- "Company" / "FoodChacha" refers to the FoodChacha platform
- "User" refers to customers using the app
- "Restaurant Partner" refers to food vendors listed on the platform
- "Rider" refers to delivery personnel
2. Eligibility
- You must be at least 18 years old to use the Platform
- By using FoodChacha, you confirm that all information provided is accurate
3. Account Registration
- Users may be required to create an account
- You are responsible for maintaining confidentiality of your account
- FoodChacha is not responsible for unauthorized access
4. Orders & Service
- FoodChacha acts as a technology platform connecting users, restaurants, and riders
- We do not prepare food and are not responsible for food quality
- Order acceptance depends on restaurant availability
5. Pricing & Payments
- Prices are set by restaurants and may change without notice
- Delivery charges may apply
- Payment methods include:
- Cash on Delivery (COD)
- Easypaisa
- JazzCash
- All payments must be completed before or at the time of delivery
6. Order Cancellation & Refunds
6.1 Cancellation by User
- Orders may be cancelled before confirmation
- Once confirmed, cancellation may not be possible
6.2 Cancellation by FoodChacha
We may cancel orders due to:
- Restaurant unavailability
- Technical issues
- Suspected fraud
6.3 Refund Policy
- Refunds (if applicable) will be processed within 3–7 business days
- Refund method depends on original payment method
7. Delivery Policy
- Estimated delivery time is approximate and may vary
- Delays may occur due to traffic, weather, or high demand
- Users must provide accurate address and contact details
8. User Responsibilities
You agree NOT to:
- Provide false information
- Misuse the platform
- Harass riders or restaurant staff
- Engage in fraudulent activities
9. Restaurant Responsibility
- Restaurants are responsible for:
- Food quality
- Hygiene
- Accurate menu information
FoodChacha is not liable for food-related issues.
10. Rider Responsibility
- Riders are responsible for timely delivery
- Riders must behave professionally
- Any misconduct can lead to termination
11. Intellectual Property
- All content, logos, and branding of FoodChacha are owned by the Company
- Unauthorized use is strictly prohibited
12. Limitation of Liability
FoodChacha shall not be liable for:
- Food quality issues
- Delivery delays beyond control
- Losses resulting from misuse of the platform
Use of the platform is at your own risk.
13. Indemnification
You agree to indemnify and hold FoodChacha harmless from any claims, damages, or losses arising from:
- Violation of these Terms
- Misuse of the platform
14. Termination
We reserve the right to:
- Suspend or terminate accounts
- Refuse service at any time
15. Privacy
Your use of the platform is also governed by our Privacy Policy.
16. International Use
If FoodChacha operates internationally, users must comply with local laws and regulations.
17. Changes to Terms
FoodChacha may update these Terms at any time. Continued use means acceptance of updated Terms.
18. Governing Law
These Terms shall be governed by the laws of Pakistan.
In case of international operations, local laws may also apply.
